JENSEN HUGHES has built a reputation on its ability to review, analyze and forecast changes to international, federal, state and local environmental, safety and health (ESH) statutes and regulations affecting client business operations. Our engineers focus on determining the applicability of current and future mandates to our client’s facilities and operations, identifying impacts to cost and continuity of operations and developing solution sets to mitigate these impacts. We recommend engaging in the rulemaking process at the earliest stages to ensure that regulators make well-informed decisions and that our clients have as much time as possible to prepare for potential changes to their operations. Regulatory analysis is one of the three interrelated aspects of our approach to material and process assessment.

Major Federal Laws and Regulations

  • Substantial expertise dealing with ESH laws and regulations at the federal level, including the Clean Air Act (CAA), National Ambient Air Quality Standards (NAAQS), National Emission Standards for Hazardous Air Pollutants (NESHAP) and Permissible Exposure Limits (PEL)
  • Support our clients in responding to data requests from agencies such as the Occupational Safety and Health Administration (OSHA) as well as the Environmental Protection Agency (EPA), including Section 114 requests under the Clean Air Act
  • Prepare formal comments on proposed rules, identify optimal compliance strategies and forecast how regulations may change in the future

State and Local Regulations

  • Broad experience analyzing ESOH regulations at the state and local levels, which vary widely based on the physical location of your facilities and operations
  • Understand how the impacts of such regulations can be felt nationwide as other states and localities insert the same or similar language into their own regulations
  • Determine how these state and local rules apply to you and identify the next steps to be taken

International Treaties and Regulations

  • Integral in developing and monitoring international treaties related to environmental protection, in particular those regarding ozone depletion and global warming, such as the Montreal Protocol
  • Analyze the impacts of international regulations on U.S. and global operations, including REACH, RoHS and WEEE
  • Chair committees, lead working groups and author technical reports for the United Nations Environment Programme (UNEP) and NATO’s Science for Peace and Security Program, among other international bodies
