The Expert Witness Process

- Evidence – Applicant: An expert report will be prepared based on inspections, document assessments, and review of legislation, BCA, and standards.
- Evidence – Respondent: The respondent will review the expert report and respond by preparing a reply report.
- Mediation: A joint expert conference or conclave and mediation will be conducted to determine a potential settlement.
- Court Hearing: If no settlement is reached, court attendance which involves cross-examination will occur.
